In Georgia, wrongful death occurs when someone dies due to the negligence of another person. An example would be a death caused by a drunk driver. You can file a lawsuit to recover money damages including the the economic value of the deceased's normal life expectancy, medical bills, funeral expenses, and punitive damages, as allowed by Georgia Law.
In Wrongful death cases, you can make two types of claims:
1) Claims brought on the part of the family member 2) Claim on behalf of the deceased person’s estate
Any proceeds from a claim on behalf of the deceased person’s estate would be paid out according to the will of the deceased. If there is no will, Georgia intestate succession applies. Wrongful death monies would be paid out according to Georgia law.
