Do I need to hire an attorney?
We recommend that you consult with us as soon as possible after your injury, because workers compensation laws are very complex and technical. There are certain legal time requirements that must be met to protect your workers comp claim. You may lose your claim or benefits if you do not follow the law exactly.
Doesn’t my employer provide me with legal advice and financial compensation for my claim?
Unfortunately, your company does not provide you with legal advice. The employer and their insurance company are protecting their own interests, and have their own attorneys to advise them. You need us to protect your interests, and make sure that you get everything that you are entitled to under the law.
I want to sue my employer, is that possible?
Almost never. Workers Compensation benefits are given to protect the employer so that they are not required to defend a lawsuit.
What benefits does Workers Compensation provide?
The basic benefits are as follows: Weekly disability benefits: Although amounts may vary, you should receive 2/3rds of your lost wages, up to a maximum of $375.00 per week for injuries occurring after July, 2000. On older claims, the amount is dependent on the law in effect at the time of the injury. Medical benefits. You are required, by law, to be treated by a doctor on the employer's approved doctors list posted at your place of employment. In rare cases, you might be able to use your own doctor.
How will my attorney fees be paid?
Attorney fees are regulated by law, but our policy is not to charge you any attorney fees unless you are able to make a recovery. The fees are capped at 25% of recovered benefits.
